This policy explains how we collect, use, store and protect personal information when you use our website, request a quotation, place an order, submit stock for review, enquire about an event or activation, subscribe to marketing or otherwise deal with us.
UK organisations collecting personal information are required to explain who they are, why they process personal information, their lawful basis, who information may be shared with and how long it may be retained.
2. Information we may collect
Depending on how you interact with us, we may collect information including your name, business or organisation name, job title, postal or delivery address, email address, telephone number and other contact details.
When requesting a quotation or placing an order, we may also collect product requirements, garment sizes, quantities, artwork, logos, names or other personalisation information, delivery details, project deadlines and correspondence relating to the order.
For Pop-Up-Print Co enquiries, this may include event names, venues, dates, expected attendance, production requirements, artwork, event briefs and information about agency or brand contacts.
For MCS Trade & Fulfilment, we may collect information about your business, website, order volumes, products, production requirements, fulfilment requirements and account arrangements.
For MCS ReMARKET enquiries, we may collect company details, stock descriptions, quantities, locations, photographs, stock manifests, indicative values, asking prices and information relating to the proposed sale, consignment or recovery arrangement.
We may also collect technical information when you visit our website, including IP address, browser type, device information, pages visited, referring website and website usage information where permitted by applicable cookie and privacy rules.
Where payment is required, payment information may be processed by our payment service providers. We do not normally retain complete payment-card information ourselves.
3. Information obtained from other sources
We may sometimes obtain business contact information from sources other than the individual concerned. This may include publicly available company websites, business directories, professional networking platforms, enquiry or lead platforms, event directories, referrals and other legitimate commercial sources.
Where personal information relating to an identifiable business contact is used, UK data protection law continues to apply even where that person is acting in a professional capacity.
We aim to tell business contacts how their information is being used and provide a straightforward way to object to marketing communications.
4. How we use personal information
We may use personal information to respond to enquiries and quotation requests; provide products and services; manage orders, production, personalisation and delivery; plan and deliver events and activations; administer trade and fulfilment accounts; assess ReMARKET stock opportunities; manage invoices, payments and accounting; communicate about existing projects or customer relationships; provide customer service; deal with complaints or disputes; improve our website and services; protect our business and systems; and comply with legal, tax and regulatory requirements.
We may also use appropriate business contact information to promote relevant MCS Group products and services where permitted by law.
5. Our lawful bases
We only process personal information where we have an appropriate lawful basis.
Contract may apply where information is required to provide a quotation, fulfil an order, deliver a service or take steps requested before entering into an agreement.
Legal obligation may apply where we are required to retain or disclose information for tax, accounting, regulatory or other legal purposes.
Legitimate interests may apply where processing is reasonably necessary for running and developing our business, managing customer and supplier relationships, preventing fraud, maintaining records, responding to enquiries and carrying out proportionate business-to-business marketing.
Consent may apply where you have actively chosen to receive marketing communications or where consent is required for non-essential cookies or another particular activity.
There is no single lawful basis that applies to every use of personal information; the appropriate basis depends on the purpose for which the information is being processed.
6. Marketing communications
If you subscribe to our newsletter or specifically ask to receive marketing, we may contact you about MCS Group news, products, services, events or offers.
You can unsubscribe at any time by using the unsubscribe option provided in a marketing message or by contacting us.
We may also carry out proportionate business-to-business marketing. The rules differ depending on whether the recipient is a corporate body, such as a limited company, or an individual subscriber such as a sole trader. Corporate B2B email marketing does not generally require prior consent under PECR, although UK GDPR still applies where identifiable personal information is used, and recipients must be able to object or opt out.
We will respect objections and maintain appropriate suppression records so that people or businesses that have opted out are not inadvertently contacted again.
7. Who we share information with
We do not sell personal information to third parties.
Where necessary to operate our business, information may be shared with companies that provide website hosting and technology services, email and communications systems, payment processing, accounting and professional advice, garment and merchandise suppliers, production partners where specialist services are required, couriers and delivery companies, IT and security providers, analytics providers and other contractors acting on our behalf.
Information may also be shared between relevant MCS Group divisions where this is necessary to respond to an enquiry or deliver the service requested.
We may disclose information where required by law, regulation, court order or another lawful authority.
8. Squarespace and website services
Our website is built and hosted using Squarespace. As a result, certain website information may be processed using Squarespace's systems and infrastructure.
We may also use website analytics and other technology to understand website traffic and improve the performance and usability of the site.
Additional information about cookies and tracking technologies is provided in our Cookie Policy.
9. Cookies
Our website may use cookies and similar technologies for essential website functionality, preferences, analytics and, where enabled, other optional purposes.
Under UK rules, visitors must receive clear information about cookies and similar technologies. Non-essential cookies generally require appropriate consent before they are placed or accessed.
You can manage your cookie preferences through the cookie controls provided on our website.
We recommend reading our separate Cookie Policy for more detailed information.
10. International transfers
Some of the technology providers, software services, suppliers or processors we use may process personal information outside the United Kingdom.
Where personal information is transferred internationally, we take reasonable steps to ensure that an appropriate legal mechanism is in place, such as UK adequacy regulations or approved contractual safeguards where required.
11. How long we keep information
We do not keep personal information for longer than reasonably necessary for the purpose for which it was collected.
Enquiries that do not become customers will normally be retained only for a reasonable follow-up period.
Customer, order, financial and transaction information may generally be retained for up to six years or longer where required by tax, accounting, contractual or legal obligations.
Artwork, production files, logos and approved product specifications may be retained while an active customer relationship exists to make repeat ordering easier.
Event briefs and project information are retained for an appropriate period following completion of the project.
ReMARKET stock submissions that do not progress may be deleted or reviewed after a reasonable period.
Marketing information may be retained until consent is withdrawn, marketing is objected to, or the information is no longer relevant. We may retain minimal suppression information after an opt-out so that the preference continues to be respected.
12. Children's information
Our website and business services are primarily directed at businesses, organisations and adult customers.
However, some MC Sports orders may involve children's sports teams, schools or youth organisations. In these circumstances we may receive limited information such as a child's name, initials, garment size or squad number where this is necessary to personalise or supply an order.
We expect the parent, guardian, club, school or organisation providing this information to have an appropriate lawful basis or permission to provide it and to supply only the information genuinely required for the order.
13. Security
We take reasonable organisational and technical measures designed to protect personal information against unauthorised access, accidental loss, misuse, alteration or disclosure.
Access to personal information is limited to people and service providers who require it for legitimate business purposes.
No online system can be guaranteed to be completely secure, but we regularly review how information is handled and aim to use appropriate safeguards.
14. Automated decision-making
We do not currently use personal information to make solely automated decisions that produce legal or similarly significant effects on individuals.
If this changes, this privacy policy will be updated.
15. Your data protection rights
Depending on the circumstances, you may have rights to:
request access to personal information we hold about you;
ask us to correct inaccurate or incomplete information;
request deletion of information in certain circumstances;
request restriction of processing;
object to certain types of processing, including direct marketing;
request transfer of information in certain circumstances;
withdraw consent where processing is based on consent; and
complain to the Information Commissioner's Office.
The right to object to use of personal information for direct marketing is particularly strong, and organisations must stop using the information for that purpose where a valid objection is made.
To exercise a data protection right, contact us using the details at the top of this policy.
We may need to confirm your identity before processing certain requests.
16. Complaints
If you have concerns about how we handle your personal information, please contact us first so that we have an opportunity to investigate.
You also have the right to complain to the Information Commissioner's Office (ICO), the UK's independent data protection regulator.

We may update this policy from time to time to reflect changes to our services, website, suppliers, technology or legal obligations.
